Wyoming (WY) - State Requirements for Ignition Interlock Devices

The Wyoming Ignition Interlock Program

The legal blood alcohol content (BAC) limit is .08 percent, as it is in every state except Utah. Offenders caught driving with a BAC at or above .08 percent risk a variety of penalties, including license suspension. This is the case even for first offenders. However, some offenders may be able to get their driving privileges back during the suspension period if they install an ignition interlock device.

Wyoming has financial, criminal, and administrative penalties for DUI. Some of the penalties increase if there are prior offenses on record, or depending on what occurred during the incident.

What Happens if I Get a DUI in Wyoming?

If injury or death was caused during the accident, fines increase and the potential jail term increases to 10 years. Offenders who have a minor in the car will also be subject to additional penalties. Drivers convicted of DUI in Wyoming risk the following penalties, which apply to all DUI offenders:

First DUI Offense

  • Jail term of up to six months
  • Fines up to $750
  • License suspended for 90 days
  • Interlock required for six months if BAC > .15
  • May be required to attend treatment
  • The judge can place offenders on probation for up to three years

Second DUI Offense

  • Jail time of seven days to six months
  • Fine of $200 to $750
  • License suspended for one year
  • Ignition interlock required for one year
  • May be required to undergo treatment evaluation
  • The judge can place offenders on probation for up to three years

Third DUI Offense

  • Jail time of 30 days to six months
  • Fine of $750 to $3,000
  • License suspended for three years
  • Interlock required for two years
  • May be required to undergo treatment evaluation
  • The judge can place offenders on probation for up to three years

What Happens if I Fail to Complete or Refuse to Submit to a DUI Test in Wyoming?

Refusing a chemical test in Wyoming will result in an immediate license suspension. Other penalties may apply and may increase if law enforcement obtains a warrant for a blood or urine sample.

How Do I Regain Driving Privileges in Wyoming?

Some offenders in Wyoming can obtain an ignition interlock restricted license, which will allow them to drive during a suspension period. Once they have been given notice of the interlock requirement from the Wyoming Department of Transportation, here is how offenders can obtain the restricted license:

  • Install a state-approved interlock device in any vehicle you plan on driving, at an approved service center
  • Provide a certificate of installation proving that your IID was installed by a Wyoming-certified technician
  • Show proof of and file SR-22 insurance with the DOT
  • Apply for the “IIR” restricted driver’s license
  • Pay necessary fees, including the $50 reinstatement fee, regular driver’s license fee, and $100 IID administrative fee
Additional qualifications may be required depending on the offense. Commercial drivers license holders are not eligible for the IID restricted license.
